California Dog Bite Law
California Civil Code section 3342(a) provides: “The owner of any dog is liable for the damages suffered by any person who is bitten by the dog while in a public place or lawfully in a private place, including the property of the owner of the dog, regardless of the former viciousness of the dog or the owner’s knowledge of such viciousness.”
Strict Liability for Wild Animals That Are Dangerous By Nature
In California, the owner or keeper of an animal that is dangerous by nature, or of any animal that he or she knows, or has reason to know, to have dangerous propensities, is liable, without wrongful intent or negligence, for damage to others resulting from such a propensity. Wild animals, such as chimpanzees, are presumed to be dangerous.
Strict Liability for Horses
Horses are not presumed to be dangerous; however, a horse may have dangerous propensities, such as jumping out of a ring at a horse riding exhibition into an area where spectators may be standing, which may make the owner or keeper strictly liable.
